DSL Agreement
The term of this is agreement is for tweleve(12) months
from the date hereof.
Integrated Data Systems agrees to provide the undersigned
user ("user") with access to the Internet via DSL MODEM.
User agrees to pay for this service in advance unless specifically
agreed to in writing and this agreement is subject to all the terms
and conditions of the standard terms of service agreement as found
on web site at www.bayoutech.net/tos.asp
User agrees that Integrated Data Systems total liability hereunder;
including but not limited to any alleged negligence of Integrated Data Systems shall
not exceed the amount paid for service. In no event will Integrated Data Systems be
liable for any incidental or consequential damages, including without
limitation, loss of use, loss of data, loss of profit, or loss of
monies, or liability to third parties, however caused, whether by
negligence of Integrated Data Systems or otherwise. User agrees and herein authorizes
Integrated Data Systems to attach the appropriate line service to user's phone line
to accomplish the providing of the herein-described services.
If modem is leased from Integrated Data Systems it requires a $50.00
(fifty dollars) deposit with a monthly lease fee of $10.00 (ten dollars) per month.
User agrees to return said modem to the office of Integrated Data Systems within ten (10) days of termination
of service. Failure to return said modem by 5:00 PM on the tenth
day after the day service is terminated shall constitute authorization
by user to Integrated Data Systems to charge the original retail value of said modem
to user's account.
Integrated Data Systems reserves the right to cancel service at any
time for any reason without prior notice. Should user move from
the premises of the original location of the DSL service and wish
to transfer the service to a new location, Integrated Data Systems shall charge a transfer
fee of $60.00 to be paid in advance by the customer. Should a user
wish to terminate this agreement within twelve (12) months from the
date hereof, user shall pay a $175.00 termination fee in addition
to normal user fees. Termination of services by Integrated Data Systems or user does
not constitute relief to user from any unpaid debts incurred before
termination of this agreement. Termination of services will only
be accepted by email to billing@teche.net, or by certified mail
to 311 Chennault, Morgan City, Louisiana 70380.
In the event Integrated Data Systems utilizes an attorney
to collect any unpaid debts, user shall be responsible for the payment
of all of Integrated Data Systems attorney fees and costs in pursuing
the collection of such unpaid debts. Venue for any litigation concerning
this agreement shall be in St. Mary Parish, Louisiana. User also
agrees, in the event that account is placed for collection, user
will be responsible for a 40% collection fee incurred due to the
collection process; as well as legal fees if necessary.
