  1. Disclaimer ; Integrated Data Systems. reserves the right to modify this document as it deems necessary without permission or consent of its network users, and the current terms of service (TOS) will remain available online to all users via the network. Use of Integrated Data Systemsservices constitutes acceptance of all terms and conditions of the TOS. Use of any information obtained from Integrated Data Systems or through its networks is entirely at users own risk. Integrated Data Systems makes no warranties and accepts no responsibility for the accuracy or quality of such information. Integrated Data Systems will not be responsible for any damage, including direct, indirect, consequential or incidental, that is incurred or suffered. This includes but is not limited to, loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or others omissions or errors.

  2. System Abuse: Use of Integrated Data Systems services in violation of any applicable federal, state, local law or regulation is prohibited. User account may be immediately terminated without user notice or refund of any subscription fees due to violations, which are determined by Integrated Data Systems to be system abuse. Activities which are identified as system abuse include, but are not limited to:

    1. Falsifying header information on any email message or Usenet posting.

    2. Posting a single off-topic article or advertisement to several Usenet Groups or mailing list.

    3. Sending unsolicited commercial email ("junk mail").This includes, but is not limited to, bulk mailing of commercial advertising, chain letters and/or pyramid-selling schemes, and informational announcements. Such material may only be sent to those who have explicitly requested it.

    4. Sending threatening or harassing email such as the threat of violence or damage to persons or property.

    5. Background processes, IRC BOTS, servers, or any type of unattended process.

    6. Attempting to circumvent security on any host or server via connection through Integrated Data Systems networks.

  3. Personal Dial-up Account Access:A dial-up account with Integrated Data Systems entitles only the named user and members of the same household living at the same address to establish a dial-up connection. Under no circumstances may multiple dial-up connections (double logins) be established simultaneously to the same account. If multiple connections (double logins) are encountered the user will be billed a second dial-up account for each billing cycle encountered. A personal World Wide Web home page may not be used for commercial activity. Integrated Data Systems reserves the right to determine what is considered commercial web marketing and sales.

  4. Data Storage and File Transfer: User agrees that Integrated Data Systems provides temporary storage of data. User is responsible for providing own archival storage of data, and Integrated Data Systems shall have no responsibility for failure to backup or loss of user data. Personal data may only be stored in the user's home directory. For personal home pages, storage space is limited to 5 MB at no extra charge. An email account includes a mail spool storage limitation of 5 MB. An additional charge of $1.00 per month per megabyte will be assessed on a prorated basis for all storage in excess of these limitations. Personal home pages are allowed 250 MB of traffic per month at no charge, and an additional charge of $.15 per megabyte will be assessed for file transfer in excess of this limit.

  5. Account Billing: The monthly billing cycle begins on the first day of each calendar month. For accounts not activated on the first of the month, charges will be prorated for the first month of service. Invoices for service are submitted monthly in advance, and charges will accrue each month until notification by user of account termination. Any billing dispute not reported to Integrated Data Systems within 60 days of the invoice date is invalid.

    1. Timed Plans: Overuse fees are billed the month after the billing cycle for which they apply at a rate of $1.50 per hour over your account plan.

    2. Late Fee: A $5.00 late fee will be billed to any account not paid in full by the first of the following month.

    3. NSF Fee: There will be a $20.00 non-sufficient funds (NSF) fee charged for each NSF check received.

    4. Certified Letter Fee: A $10.00 fee will be charged to any account for which a certified letter must be delivered for collection of past due amounts.

    5. Reconnect Fee A $10.00 reconnect fee will be billed to any account suspended for non-payment prior to reactivation of services.

  6. Account Modifications: Account modifications to an account will become effective on the first day of the next billing period, and are charged $5.00 per occurrence. A modification is any change to username/email address, service plan, etc. There is no charge for changes in personal information such as a password change or change of address. Invoices are processed on the first of the month and payment is due upon receipt for current monthly fees and all additional charges incurred during the previous month. Accounts are delinquent if account balance is not paid in full by the 25th of the month. Access to service may be denied without user notice for any delinquent account, and a $10 service charge will be assessed to reinstate service.

  7. Account Termination: Account termination is effective on the last day of the calendar month in which the termination request is received. User will be assigned an account termination number, which will verify that the request has been received, and all future inquiries about the terminated account must be accompanied with the account termination number. A termination request is not valid without this assigned account termination number, regardless of whether or not the account has been used. Charges are not prorated for the last month of service, and no refunds will be made for any account termination for any reason.
